The most important regulations

The contents of the most important law and order provisions in terms of their relevance and the projected frequency of violations thereof in the City of Krakow during the World Youth Day.

 

Mandat karny

 

1. polluting or littering space available to the public, in particular roads, streets, squares, gardens, lawns and other green spaces

Violated provision: Article 145 of the Code of Petty Offenses

Penal sanction:

2. effecting sales in an area belonging to the municipality or administered by it, in places other than those designated for this purpose by the competent municipal authorities

Violated provision: Article 603(1) of the Code of Petty Offenses

Penal sanction:

Explanation: itinerant trade in areas belonging to the municipality, in places other than designated ones (such as, e.g. market places)

3. selling commodities held in hands, baskets, stalls, horse-drawn carts, trailers, cars, etc., as well as selling animals, means of transport and parts thereto, without a permit of the owner (administrator) of the area

Violated provision: Article 54 of the Code of Petty Offenses, in conjunction with Article 4 in conjunction with Article 1 of the Krakow City Council’s Resolution No. XXIII/220/95 of 7 June 1995 on itinerant trade in Krakow

Penal sanction:

Explanation: itinerant trade on areas other than those belonging to the municipality, without a permit of the owner (administrator) of the area

4. intentional (par. 1) of unintentional (par. 2) violation of prohibitions or restrictions in force in the cultural park or part thereof

Article 112(1) and (2) of the Act on the Protection and Guardianship of Monuments

e.g. a prohibition to render services or effect sales in doorways, passages and driveways to buildings and the prohibition to display goods and offer them for sale in front of buildings and on the facades of buildings, prohibitions of and restrictions on the placement of advertising media and visual media; conducting street performances, providing services and effecting trade, organization of events – without the necessary permits, in the Old Town Cultural Park - within the Planty Park

5. breach of the peace, violation of public order or disturbance during quiet hours with screaming, a noise, alarm or other misbehavior, or scandalous behavior in public

Article 51(1) of the Code of Petty Offenses

par. 2 – in the event of an act of hooliganism, or when the perpetrator commits it under the influence of alcohol Par.

6. destruction of or damage to vegetation in areas intended for public use, trampling lawn and other green spaces in areas intended for public use, in locations other than those designated for recreational purposes by the competent administrator of the area

Article 144(1) of the Code of Petty Offenses

7. removing, destroying or damaging trees or shrubs forming roadside foliage or protection, or roadside hedge

8. ignoring a traffic sign or signal or a signal or command of a person authorized to manage traffic or to traffic control

Article 92(1) of the Code of Petty Offenses

applies to offenses committed by both pedestrians and drivers

9. blocking or obstructing traffic on a public road in a residential or traffic zone

Article 90 of the Code of Petty Offenses

applies to offenses committed by both pedestrians and drivers

10. violating other provisions of the Act of 20 June 1997 – Road Traffic Law, or regulations issued based thereon, by a traffic participant or any other person who is on a public road in a residential or traffic zone

Article 97 of the Code of Petty Offenses

applies to offenses committed by both pedestrians and drivers, e.g.

- running across the street – a penalty notice of PLN 50
- walking along a track – a penalty notice of PLN 50
- entering a level crossing when barriers or half barriers are down or have started moving downwards – a penalty notice of PLN 100
- violation by a pedestrian of the obligation to use a pedestrian walkway or road, or, in the absence thereof – the roadside – a penalty notice of PLN 50
- violation of the obligation to use crosswalks when crossing a road or track – a penalty notice of PLN 50
- violation by a pedestrian of the obligation to move on a road one after another – a penalty notice of PLN 50
- using roads by pedestrians where they are not allowed – a penalty notice of PLN 50
- violation of regulations governing pedestrian traffic on bicycle lanes – a penalty notice of PLN 50
- stopping a vehicle at an intersection – a penalty notice of PLN 300

11. consumption of alcoholic beverages in spite of prohibitions set out in Article 14(1) and (2)(a)-(6) or the purchase or consumption of alcoholic beverages in illegal points of sale, or consumption of alcoholic beverages brought by oneself or another person in places designated for their sale or serving

par. 2 – an attempt to commit this offense

Article 431(1) of the Act of 26 October 1982 on Upbringing in Sobriety and Counteracting Alcoholism (Article 431(2) – an attempt to commit this offense)

the prohibition applies to:

- streets, squares and parks;
- public green areas

-  undeveloped areas of forts
- underpasses and establishments located therein
- areas of fenced playgrounds for children
- bathing areas
- areas of schools and other educational and nursing establishments and institutions and dormitories; areas of workplaces and mass caterers for staff; venues of mass gatherings at the time when they are held; public transport means and facilities (with an exception of restaurant and buffet cars on trains where it is allowed to sell, serve and consume alcoholic beverages with an alcohol content of up to 4.5% and beer)

12. smoking tobacco products in areas covered by the prohibitions set out in Article 5

Article 13(2) of the Act on the Protection of Health against the Consequences of Tobacco and Tobacco Products Use

the prohibition applies to, among others:

- public transport stops, bus stations and terminuses with respect to station infrastructure (sheds, platforms and bays)
- areas designated for playgrounds for children, including open-air playgrounds
- Parks: Krakowski, Bednarski, Dr. H. Jordan ones
- catering and entertainment facilities

- areas of universities;
- premises of sports, cultural and recreational facilities
- means of public passenger transport and facilities for travellers;
- other premises for public use

13. placing announcements, posters, placards, appeals, leaflets, notes or drawings in a public area not designated for this purpose, or exposing them to public view in a different place without a permit of its administrator

Article 63a of the Code of Petty Offenses

aiding and abetting shall be punishable

NOTE: this act may constitute a crime in the event of destruction of or damage to the façade of a building or another object (e.g. a monument), which shall be punishable with a fine, restriction of freedom or imprisonment

14. placing obscene adverts, notes or drawings in a public place, or using obscene language in a public place

Article 141 of the Code of Petty Offenses

15. begging in a public place by those who have means of livelihood or are able to work (par. 1), or begging in a public place in an insistent or fraudulent manner (par. 2)

Article 58(1) or (2)of the Code of Petty Offenses

16. organizing or conducting a public collection of funds for victims, with no previous necessary notification or incompliant with such a notification

Article 56(1) of the Code of Petty Offenses

aiding and abetting shall be punishable

17. disturbing or attempting to disturb the organization or the conduct of a lawful gathering, convening a gathering without a required notification or chairing such a gathering or a prohibited gathering, chairing a gathering after its dissolution by its chairperson or a representative of a municipal authority, illegal occupation of or refusal to leave a place which is lawfully administered by another person or organization as the body convening or chairing a given gathering, taking part in a gathering while being in possession of a weapon, explosives or other dangerous instruments

Article 52(1) of the Code of Petty Offenses

aiding and abetting shall be punishable

18. bathing in a place where this is forbidden
